Equip Networks Terms and Conditions

Acceptance

The “equipnetworks.com.au” website (“website”) is operated by Equip Networks Pty Ltd; ABN 44 607 933 399 (” Equip Networks”). Your use of the website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers set out below (“Terms and Conditions”). The Terms and Conditions govern your use of the website and the materials and information accessible on or from the website. You should read the Terms and Conditions now. Equip Networks reserves the right to amend the website and the Terms and Conditions at any time and from time to time without notice to you. Your continued use of the website after any amendment to the Terms and Conditions constitutes an agreement by you to abide and be bound by the Terms and Conditions, as so amended. Your use of the website means you accept these Terms and Conditions. You must not access, browse or use this website unless you agree to be bound by the Terms and Conditions set out below. If you do not agree with these Terms and Conditions you must not visit or use the website.

Capacity

The products on the website are only available for sale to individuals who can make legally binding contracts. The products are not available to persons under the age of 18 years and any other persons who are legally prohibited from entering into binding contracts. By making an on-line purchase, you accept these terms and conditions and acknowledge that you are over the age of eighteen (18) years.

Should Equip Networks suffer any loss or damage as a result of a transaction entered into by a minor, Equip Networks reserves the right to seek compensation and to take legal action for such losses from the parents or guardians of the minor who caused the order to be placed.

Orders

Customer may order Products and Services from Equip Networks submitting an electronic purchase order (“Order”) through the Equip Networks (“Website”).

By placing an Order Customer agrees to be bound by these Terms of Supply (“Terms”) and any additional terms specified in the Order. If Equip Networks accepts an Order then these Terms and any additional terms specified in the Order constitute an agreement for the supply of the Products and Services (“Agreement”).

The parties agree that if there is any inconsistency between these Terms and a term specified in an Order then the term specified in the Order will prevail to the extent of the inconsistency.

Any order placed by you in the manner described on this website is an offer by you to purchase a particular product for the price (including the delivery and other charges and taxes) specified on this website at the time you place your order. Equip Networks reserves the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order.

The rejection of any offer by Equip Networks is at the sole discretion of Equip Networks. Your contract with Equip Networks only comes into existence when Equip Networks forwards to you confirmation of receipt of your order and payment.

Prices

All prices displayed on the website, including but not limited to prices of products and services and delivery and other charges, are quoted in Australian Dollars and are current at the time of issue, but may change at any time without notice and are subject to availability. Any changes to prices displayed on the website are at the sole discretion of Equip Networks.

Payment

The pricing of Products will be as specified on the Website at the time Customer submits the Order. Sundry charges; freight, handling and insurance costs etc may be additional to the purchase price and may be shown separately on Equip Networks invoices.

Customer acknowledges that after order submission any cancellation will be at the absolute discretion of Equip Networks. If Equip Networks does consent to the cancellation of an Order, Customer must pay all fees and costs incurred by Equip Networks, including without limitation any cancellation fee or rescheduling fee due to a supplier of Equip Networks as a consequence of Equip Networks cancelling an order placed with its supplier in fulfilling the cancelled Order.

Customer acknowledges that Equip Networks may charge Customer’s credit card (or such other payment method as is made available to Equip Networks through the Website by Customer) all amounts payable in connection with an Order at any time after an Order is submitted.

Goods and Services (“GST”) and Other Taxes

Prices displayed on this website are exclusive of GST. The GST applied rate of 10% is added to the cost of purchase at the point of checkout and is added to the order and invoice.

You are responsible for the payment of any and all taxes, duties, charges, imposts or other liabilities imposed by any government agency, government taxation agency or other government body, including without limitation, any customs duty, any additional GST payable or any value added tax imposed on any products or services acquired or ordered by you from this website.

Delivery

Please read the Delivery Information contained in the website. The delivery times are indicative only and Equip Networks will not be liable for any failure to observe these delivery times.

Risk and Title

Equip Networks will retain title to all products you order until you have made payment in full for those products but all risk in the products will pass to you upon the delivery of the products to, or the collection of the products by, a postal or courier service. You should consider whether to obtain any suitable insurance in respect of the products.

Product selection assistance/consultancy

Equip Networks offers a level of product assistance and consultancy as a part of the service. Customer may request assistance from Equip Networks with regard to the purchase of any Products. Customer acknowledges the following

  • Any such assistance is provided solely as a convenience to Customer and without obligation or liability on the part of Equip Networks;
  • Any such assistance does not constitute professional advice, and must not be relied upon by Customer or by any other person;
  • Customer must make enquiries independently of Equip Networks as to requirements for Products and Services, and must validate that any Products or Services ordered are appropriate to meet those requirements; and
  • Customer releases Equip Networks from any liability for any costs or losses Customer may incur in connection with the purchase of Products or Services, even if even if Equip Networks provided Product consultancy and selection assistance to Customer.

Returns

It is at the absolute discretion of Equip Networks to agree to accept the return of Products purchased though the Equip Networks Website. Equip Networks will only consider accepting the return of Products if the following specified conditions are satisfied.

Products can only be returned to Equip Networks for credit within 7 days from the date that the Products were invoiced to Customer.

Returned products will only be credited to Customer at the lower of the amount invoiced and the current market value of the Products at the date of return, such value to be determined by Equip Networks at Equip Networks’ absolute discretion.

All Products to be returned must have a returns authorisation (RA) number clearly visible on the outside of the package. The product must be unopened and in saleable condition as determined by Equip Networks. Damaged goods are not eligible for return.

Once approved, all Product returns must be returned to Equip Networks within 3 days of the RA number being issued or the returned Products will be declined.

A minimum 10% restocking fee will be applied to all returns, payable prior to Equip Networks accepting the returned Product from Customer.

Warranty

Equip Networks may make certain warranties with regard to Products and Services The sale invoice supplied to customer will have these warranties specified within.

Equip Networks does not warrant nor represent that Products are supplied with a valid software licence. Furthermore, Equip Networks does not warrant that third party software supplied is of a particular type or quality.

Manufacturer’s Software Licence provision

Customer acknowledges that:

Products purchased from Equip Networks may be supplied with software owned or controlled by third parties.

It is at the sole discretion of the Customer to ensure that rights to use any software or other such materials required to use the product are properly acquired and legally. The cost of third party vendor software licences which may be required to operate the product are not included in the price charged by Equip Networks for the Products or Services through the Website.

Support for products must be obtained directly from the manufacturer or from an authorised vendor, dealer or distributor.

Limitation of liability

Equip Networks will in no way be liable for any direct, indirect, incidental, special or consequential loss or damage (including loss of profits, revenue, production, opportunity, access to markets, goodwill, reputation, use or any indirect, remote, abnormal or unforeseeable loss), resulting from use or inability to use the website or for the cost of procurement of substitute products or resulting from any products purchased or obtained or messages received or transactions entered into through the website or resulting from unauthorized access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if Equip Networks or related entities of Equip Networks have been advised of the possibility of such loss or damage.

Where any Act of Parliament implies in the Terms and Conditions any term, condition or warranty, and that Act avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in the Terms and Conditions, however, the liability of Equip Networks for any breach of such term, condition or warranty shall be limited, at the option of Equip Networks, to any one or more of the following:

  • if the breach relates to goods:
  • the replacement of the goods or supply of equivalent goods;
  • the repair of such goods;
  • the payment of the cost of replacing the goods or of acquiring equivalent goods; or
  • the payment of the cost of having the goods repaired
  • if the breach to relates to services:
  • the supplying of the services again; or
  • the payment of the cost of having the services supplied again.

You agree that your access to, and use of, this website is subject to these Terms and Conditions and all applicable laws, and is at your own risk.
